These Terms and Conditions ("Terms") govern your access to and use of the Healthy Nutrition Boost website, mobile applications, and all related services (collectively, the "Platform") operated by Healthy Nutrition Boost ("Healthy Nutrition Boost"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.

1. Service Usage

1.1 Eligibility: You must be at least 18 years old and a resident of the United States to use our Platform. By using our Services, you represent that you meet these eligibility requirements.

1.2 Account Registration: You must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

1.3 Licensed Services: Our Platform facilitates access to healthcare services provided by independent, licensed healthcare professionals. Healthy Nutrition Boost is not a healthcare provider and does not directly provide medical services.

1.4 Acceptable Use: You agree not to use the Platform for any unlawful purpose, to submit false information, to harass providers or staff, to attempt to gain unauthorized access, or to interfere with the Platform's operation.

1.5 Telehealth Acknowledgment: Telehealth consultations have limitations and may not be suitable for all conditions. You acknowledge that in-person care may be necessary for certain diagnoses or treatments.

1.6 Emergency Disclaimer: Our Platform is NOT for medical emergencies. If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room.

2. Payments & Pricing

2.1 Service Fees: All service fees are displayed in US Dollars and are clearly stated before you confirm any booking. Prices may vary by provider, service type, and location.

2.2 Payment Methods: We accept major credit/debit cards (Visa, Mastercard, American Express, Discover), HSA/FSA cards, ACH bank transfers, and select digital wallets.

2.3 Insurance Billing: If you select insurance billing, we will submit claims to your insurance provider on your behalf. You remain responsible for any copays, coinsurance, deductibles, and non-covered services.

2.4 Authorization: By providing your insurance information, you authorize Healthy Nutrition Boost to bill your insurance and release medical information necessary for claims processing.

2.5 Failed Payments: If a payment fails, we may retry the charge, notify you to update payment information, or cancel your scheduled appointment.

2.6 Refunds: Refund requests must be submitted within 7 days of payment. Refunds for services already rendered are evaluated on a case-by-case basis and are not guaranteed.

2.7 Price Changes: We reserve the right to modify pricing with reasonable notice. Price changes will not affect already-booked and confirmed appointments.

3. Liability & Disclaimers

3.1 Medical Disclaimer: The Platform provides information and facilitates access to healthcare services but does not constitute medical advice. Always seek the advice of a qualified healthcare provider for medical concerns.

3.2 Provider Independence: Healthcare providers on our Platform are independent practitioners. Healthy Nutrition Boost does not control the medical judgment, diagnosis, or treatment provided by these professionals.

3.3 Limitation of Liability: To the maximum extent permitted by law, Healthy Nutrition Boost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

3.4 Maximum Liability: Our total liability for any claim arising from these Terms shall not exceed the total amount you paid to Healthy Nutrition Boost in the 12 months preceding the claim.

3.5 Accuracy of Information: While we strive for accuracy, we do not guarantee that all content on the Platform is error-free, complete, or current.

3.6 Third-Party Links: The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or policies of external sites.

3.7 Warranty Disclaimer: THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

4. Cancellation Policy

4.1 Patient Cancellations: Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled time.

4.2 Late Cancellations: Cancellations made less than 24 hours before the appointment may incur a $25 cancellation fee.

4.3 No-Shows: If you fail to appear for a scheduled appointment without cancellation, you will be charged the full service fee.

4.4 Provider Cancellations: If a provider cancels an appointment, we will offer a full refund or help you reschedule at no additional cost.

4.5 Subscription Cancellations: For recurring wellness or coaching subscriptions, you may cancel at any time. Cancellation takes effect at the end of the current billing period.

4.6 Insurance-Related Cancellations: If your insurance claim is denied after an appointment, you remain responsible for the self-pay rate of the service rendered.

5. Intellectual Property

All content, logos, trademarks, service marks, trade names, software, and designs on the Platform are the property of Healthy Nutrition Boost or its licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. Dispute Resolution

6.1 Governing Law: These Terms are governed by the laws of the District of Columbia, without regard to conflict of law principles.

6.2 Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Washington, D.C.

6.3 Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

7. Indemnification

You agree to indemnify and hold harmless Healthy Nutrition Boost, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or violation of any rights of a third party.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.
